Jakarta — Presiden Prabowo Subianto berencana merevisi Peraturan Pemerintah (PP) Nomor 20 Tahun 2021 tentang Penertiban Kawasan dan Tanah Terlantar. Revisi ini bertujuan memangkas proses pengambilalihan tanah dari 587 hari menjadi hanya 90 hari. Menteri ATR/BPN, Nusron Wahid, menegaskan percepatan tersebut dilakukan untuk mempercepat redistribusi tanah kepada rakyat.
Tanah yang ditertibkan nantinya akan dikelola pemerintah daerah dan Badan Bank Tanah, dengan klaim untuk kepentingan publik.
Namun, di balik kebijakan ambisius ini, potensi masalah besar mengintai: praktik kongkalikong antara pejabat pertanahan dan cukong tanah. Sejarah panjang konflik agraria di Indonesia menunjukkan bahwa program reforma agraria kerap dibajak oleh jaringan mafia tanah yang berkolusi dengan oknum aparat birokrasi.
Pola Kongkalikong: Cukong dan Pejabat
Dalam banyak kasus, cukong tanah menyiapkan dana dan jaringan untuk melancarkan “pengurusan” dokumen. Oknum pejabat pertanahan yang memiliki kewenangan administratif lalu memanipulasi data, menerbitkan sertifikat palsu, atau mengubah status peruntukan tanah. Hasilnya, tanah yang seharusnya diberikan kepada masyarakat justru berpindah ke tangan pemodal besar.
Praktik ini pernah terungkap dalam sejumlah kasus, mulai dari sindikat mafia tanah di Cakung hingga penangkapan pejabat BPN oleh Polda Metro Jaya. Pola yang sama selalu muncul: pemalsuan dokumen, bypass verifikasi, pengalihan peruntukan lahan, hingga kriminalisasi warga yang melawan.
Jebakan Birokrasi: Aturan Tambahan yang Mematikan Harapan
Selain manipulasi terang-terangan, jebakan birokrasi dalam bentuk aturan tambahan juga menjadi penghalang utama rakyat kecil. Alih-alih mempercepat redistribusi, aturan baru justru memperlebar celah permainan:

Tambahan dokumen: syarat kepemilikan lama, bukti bayar pajak bertahun-tahun, atau rekomendasi desa yang sulit dipenuhi masyarakat miskin, tapi gampang dilengkapi cukong.

Perubahan kriteria penerima: misalnya harus punya NPWP atau masuk daftar tertentu, membuat petani kecil tersisih.

Proses verifikasi berlapis: dari desa hingga kementerian, membuka ruang pungutan liar.

Aturan multitafsir: memberi keleluasaan pejabat untuk menafsirkan sesuai kepentingan, membuat rakyat sering kalah dalam negosiasi.
Dampaknya:

Tanah untuk rakyat miskin gagal tersalurkan.

Proses macet, lahan jatuh ke tangan cukong.

Hak rakyat lemah dikorbankan, memperbesar konflik agraria.
Membenturkan Rakyat dengan Rakyat
Modus lain yang kerap dipakai mafia tanah adalah menciptakan konflik horizontal:

Rakyat asli pemilik tanah dihadapkan dengan kelompok “rakyat bayaran” yang diklaim sebagai pemilik sah berdasarkan sertifikat baru dari oknum BPN.

Mafia tanah mendanai massa bayaran, pejabat memberi legalitas, dan aparat penegak hukum (APH) turun mengamankan pihak bayaran.

Rakyat melawan rakyat, sementara mafia dan pejabat tetap aman di balik layar.
Akibatnya, solidaritas sosial hancur, masyarakat kehilangan lahan, dan konflik agraria terus meluas.
Contoh Kasus Nyata

Bogor — Pemalsuan Sertifikat lewat PTSL
Seorang pejabat BPN bersama jaringan calo menerbitkan sertifikat palsu dengan menghapus data pemohon asli menggunakan bahan kimia, lalu mengganti nama pemohon yang telah membayar. Setiap sertifikat dipatok hingga puluhan juta rupiah. -
Tanjungpinang — Pemalsuan Sertifikat Massal
Polisi mengungkap pemalsuan sertifikat tanah yang melibatkan 6–7 tersangka dengan 237 korban. Sertifikat palsu dibuat dengan dokumen tidak resmi dan manipulasi data, banyak korban akhirnya dianggap tidak memenuhi syarat oleh kantor pertanahan. -
Bekasi & Jakarta — Mafia Tanah Terorganisasi
Dalam sebuah operasi, sekitar 30 orang ditangkap, termasuk 13 pegawai BPN aktif. Modusnya memakai “super-akun” BPN untuk mengubah data kepemilikan secara ilegal dan menerbitkan sertifikat palsu. -
Karawang — Pencopotan Pejabat ATR/BPN
Oknum pejabat ATR/BPN Karawang dicopot karena terlibat penerbitan sertifikat tanah di wilayah laut Kabupaten Bekasi yang tidak sesuai aturan.
Kasus-kasus ini menunjukkan bahwa bukan hanya dokumen palsu yang jadi alat permainan, melainkan juga penggunaan aturan administratif sebagai jebakan. Rakyat miskin yang tak bisa memenuhi syarat terpaksa menyerah, sementara lahan kembali ke tangan mafia dengan restu birokrasi.
Ancaman Reforma Agraria
Potensi konflik agraria semakin besar ketika modal dan kewenangan bersimbiosis. Jika revisi PP hanya fokus pada percepatan prosedur tanpa memperkuat pengawasan dan memberi sanksi tegas kepada pejabat yang bermain mata dengan cukong, kebijakan ini justru berisiko menjadi pintu baru praktik mafia tanah.
Alih-alih menyejahterakan rakyat, kebijakan ini bisa memperdalam luka lama: rakyat kecil terus terpinggirkan, tanah jadi komoditas segelintir pemodal, dan negara gagal hadir sebagai pelindung hak-hak masyarakat lemah.
